Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using https://whimsyinvites.com (“the Site”) operated by Whimsy Invites’ Shop (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at https://whimsyinvites.com.

Acceptance of Terms
By accessing and using the Whimsy Invites website, purchasing our products, or using our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or products.

Intellectual Property
All content on this site, including designs, text, graphics, logos, and digital products, are the exclusive property of Whimsy Invites. Unauthorized use, reproduction, or distribution is strictly prohibited.

License to Use Digital Products
Upon purchase, you are granted a non-exclusive, non-transferable license to customize and use the purchased digital product for personal use only.

You may not:

• Resell, redistribute, or sublicense the digital products or Canva templates
• Share or publicly post Canva template links
• Modify and resell derivative works based on the original templates

Violations may result in legal action.

Whimsy Invites Design Editor Use Policy
Some products are provided through the Whimsy Invites Design Editor, which allows you to customize your design online before download. By purchasing a product that uses the Design Editor, you agree to the following:

• One-Time Edit: Your customization link is for a single edit session of the purchased design. Additional edits after the initial customization may require a new purchase.
• File Access: Once customized, you may download your final files as many times as you wish using the link provided in your confirmation email. Keep this email safe; lost links may require repurchase to regain access.
• Preview Watermark Notice: Some designs may display a temporary watermark during customization or preview to protect our intellectual property. This watermark will not appear on your purchased or downloaded files.
• Customer Responsibility: You are solely responsible for reviewing and confirming all spelling, dates, and details before approving and downloading your design. Whimsy Invites is not liable for typos, omissions, or errors introduced during customer customization.
• Re-Purchase Requirement: Any request to modify a finalized design—whether due to event changes, text errors, or style adjustments—will be treated as a new order and billed accordingly.

Canva Template Use Policy
Templates provided via Canva links are intended for one-time, single-event personal use.

By accessing the Canva template, you agree to:

• Customize it only for your personal event
• Not share or distribute the template
• Not create multiple versions for different events unless re-purchased

Once you access the template, you assume full responsibility for any edits or customizations made.

Digital Product & Customization Disclaimer
By purchasing any digital product or customized design from Whimsy Invites, you acknowledge that:

• All sales are final once your customized files are delivered.
• Your purchase includes a single customization session for the selected design.
• Any changes or edits requested after purchase will require a new purchase, even if event details or text change.
• You are responsible for reviewing and confirming all spelling, dates, and details before finalizing.
• Refunds, free edits, or replacements are not provided for customer errors.

Refund Policy for Digital Goods
Due to the nature of digital products, all sales are final.

• Accessing or downloading a digital product (including Canva template links or Whimsy Invites Design Editor files) constitutes full consumption of the product.
• Once your customized files have been delivered, refunds or free edits are not available under any circumstances.
• For products customized in the Whimsy Invites Design Editor, your purchase includes a single customization session. Any edits after purchase require a new purchase.
• You are responsible for reviewing and approving all spelling, dates, and details before finalizing your design.

Printed Items: Damaged product claims must be reported within 48 hours of receipt for eligibility for replacement.

User Responsibility
You are responsible for ensuring the accuracy of all personalizations and edits you make to your templates.
Whimsy Invites is not liable for any errors resulting from customer modifications or misuse of Canva or third-party editing platforms.

Shipping Policy
Printed orders are shipped via Priority Mail through USPS within the United States.
Whimsy Invites is not liable for delays caused by postal services.
International shipping is not currently supported without prior arrangement.

Changes to Terms
We reserve the right to modify these Terms & Conditions at any time without prior notice. Changes will be posted on this page with a new effective date.

Governing Law
These terms are governed by the laws of the State of Connecticut, United States.
